Liability - The renter is highly encouraged to obtain a binder for the instrument on their homeowners’ or renters' personal belongings insurance policy. Example: an instrument with a retail purchase price of $750.00, and the homeowner’s insurance deductible of $250.00; the renter would pay Antonio Violins $500.00. (The amount paid by the homeowner’s insurance) for loss or irreparable damage to the instrument. By signing this agreement, the renter acknowledges that Antonio Violins recommends insuring the instrument to cover theft and loss or irreparable damage.
o All repairs and adjustments must be made by Antonio Violins. For instrument rentals with included maintenance, repairs due to ordinary wear and tear will be made at no cost to the renter, provided rental payments are current. If the instrument is damaged beyond normal wear and tear or through neglect, the renter will be responsible for the repair costs. All repairs and adjustments on instrument rentals without included maintenance must be made by Antonio Violins at the renter's expense.
o First-time renters receive a complimentary t-shirt, method book, folder, and music stand, which are theirs to keep. Each rental instrument is outfitted with a case, bow, rosin, cleaning cloth, spare strings, and a shoulder rest or rock stop. The renter is responsible for replacing the case, bow, shoulder rest, or rock stop should they be missing from the instrument outfit upon return or exchange.
o If the instrument is lost, stolen, or damaged beyond repair, Antonio Violins will cover up to $250 to replace the instrument, with the replacement cost being the full rental purchase price. Any account equity may be used towards the cost of the instrument. The renter is responsible for the remainder of the rental purchase price.
- Exchanges & Upgrades - Exchanges to the next instrument size will be made free of charge, provided rental payments are current, and the previous instrument is returned in good condition, considering normal wear and tear. Exchanges to higher level instruments may be made at any point, provided rental payments are current and the previous instrument is returned in good condition. Any difference in rental fees for the remaining months on the renter's contract will be due at the time of the exchange
Terms & Fees – Renter gives permission to Antonio Violins to automatically charge credit card upon renewal invoice due date. Terms and pricing are subject to change.
o Antonio Violins requires a valid credit card; a valid email address and up-to-date contact information remain on file for the duration of the rental agreement. The renter is responsible for informing Antonio Violins of any changes to their email, address, phone number, or credit card. Any credit card used in the system gives Antonio Violins the right to charge unpaid rent when customer is in delinquency for payments.
o The renter agrees to make payments on or before their rental renewal date to maintain their rental agreement. Antonio Violins will send reasonable notice of their upcoming contract renewal to the address and email address provided by the renter. Rental payments may be made online at antonioviolin.org, in person at any Antonio Violins retail location, or over the phone.
o If rent is unpaid for two consecutive months and the instrument is not returned in good condition, allowing for normal wear and tear, the instrument will be considered stolen and reported to the renter’s local police. The renter will also be responsible for the instrument's full retail purchase price and any legal expenses incurred. Additionally, the renter authorizes Antonio Violins or its representatives to repossess the instrument from the student's school, home, or home of the renter.
o If any payment is not received within 15 days of the due date, the renter will be charged a late fee of 3% of the outstanding balance. If any payment is not received within 30 days of the due date, the renter will be charged a late fee of 5% of the outstanding balance. Please note that this 5% fee will continue to accrue monthly until the full balance is paid in full.
- Equity - 100% of the student’s yearly or monthly rental fees (before tax) accumulate as equity, which can be applied toward the purchase of an orchestral instrument.
- Rental equity is specific to each student and cannot be transferred, shared, or used for other purchases.
If rent payment is current, and the instrument is returned in good condition allowing for normal wear and tear, rental equity may be applied up to 100% of the retail purchase price of instruments offered in our rental fleet of a similar instrument. Instruments not offered in our rental fleet may have rental equity applied up to 60% of the purchase price of a similar instrument. If the full-size instrument was previously used at the time that the new renter exchanged to the full size, the renter can choose to buy a new instrument of equal value.
Equity remains intact for one year following the cancellation of the rental agreement, after which it depletes by 25% each year. However, equity is fully restored if the renter enters into a new rental agreement with Antonio Violins, assuming the previous account was in good standing and the instrument was returned in good condition.
- Cancellation & Early Termination - If the renter wishes to return the instrument and end their contract, Antonio Violins will refund any unused months to the original payment method on file provided the instrument is returned in good condition, allowing for normal wear and tear. The discounted yearly rate is for fulfilled 12-month yearly contracts only. Contracts terminated before 12 months will be subject to early termination rate. Example: Level 2 violin early return price per month is $22.12 vs. rate of $16.67 per month when 12-month agreement is fulfilled.
- ALL REPAIRS AND ADJUSTMENTS MUST BE MADE BY ANTONIO VIOLINS OR ITS AGENTS. Repairs made necessary by ordinary wear and tear will be made at no cost to the renter, assuming rental payments are current. Repairs made necessary by damages beyond normal wear and tear and neglect will be repaired by Antonio Violins, at the expense of the renter. This is especially true for damages to bows caused by failure to relax the hair whenever not playing the instrument.
The undersigned hereby declares that they have read the above rental agreement, that all statements made herein are complete and true to the best of their knowledge. The renter hereby authorizes Antonio Violins to order a credit report, in conjunction with this agreement or with any subsequent update, renewal or extension of this agreement.
